Attorney Greening is available to consult with individuals seeking assistance with navigating appealing DCF decisions through the fair hearing or grievance processes.
Allegations of abuse or neglect which are “supported” by the Department of Children and Families can be appealed through the administrative appeals process called a “Fair Hearing.”
Allegations of abuse or neglect which have been determined to be a “substantiated concern” also can be appealed through the Fair Hearing process.
The fair hearing must be requested 30 days from notice of the Department’s decision to support the allegations of abuse or neglect. DCF’s website has an online form for requesting a hearing.
Other decisions DCF makes can be appealed through an administrative grievance process.
